Position Summary:
We are looking for an experienced Litigation Counsel to join our Legal Team as our Deputy General Counsel. The ideal candidate will bring extensive experience litigating restrictive covenant matters, including non-compete, non-solicitation, and confidentiality disputes. This role also requires deep expertise in advising on pre-hire and post-hire candidate counseling, particularly in high-risk or competitive hiring scenarios. The successful candidate must be comfortable appearing in court for hearings, motions, and trials, and will play a critical role in shaping litigation strategy across the organization.
This position offers a unique opportunity to work across the business on high-impact issues, advising executives and teams on legal risk and dispute resolution strategies while balancing business objectives.
Duties and Responsibilities:
- Lead and manage all aspects of litigation involving restrictive covenants, errors and omissions, and contractual disputes, from pre-litigation strategy through resolution, including trial or hearing.
- Appear in court to argue motions, attend hearings, and conduct trials as necessary.
- Provide strategic counseling on hiring and onboarding practices, including pre- and post-hire risk assessments and mitigation strategies.
- Move quickly to obtain or defeat temporary restraining orders and preliminary injunctions in restrictive covenant disputes, often on an expedited or emergency basis.
- Draft, review, and negotiate legal documents related to disputes and settlements.
- Select, retain, and supervise outside counsel, manage budgets, strategy, and case outcomes.
- Provide strategic advice to business leaders on potential litigation risks, dispute avoidance, and contract enforcement.
- Develop and execute effective strategies for arbitration and alternative dispute resolution.
- Work closely with teams across Legal, Finance, and Operations to identify risks early and ensure alignment with business objectives.
- Prepare regular litigation reports and updates for executive leadership.
- Significantly contribute to the development of litigation protocols and e-discovery management systems.
- Monitor legal trends and regulatory developments that may affect the company’s litigation exposure
- Coordinate with the General Counsel on overall litigation strategy, prioritization, and resource allocation across the Legal Department.
