The responsibilities described are for the full performance level. At developmental grade levels, assignments will be of more limited scope performed with less independence, and limited complexity.
Practices and applies federal immigration law in a dynamic environment with evolving priorities and policies in support of USCIS’s efforts to uphold national security and maintain integrity in the processing of immigration benefits.
Coordinates with Department of Justice on case strategy, drafts/reviews motions, briefs, pleadings, and declarations, coordinates/supports the discovery process, and prepares agency witnesses for hearings/trials.
Subject matters include, among others, the applicability of inadmissibility and deportability grounds, naturalization eligibility, the full range of immigration benefits under the INA, and the handling of national security and public safety concerns.
Provides training to USCIS personnel on varied legal topics arising under the Immigration and Nationality Act, and its implementing regulations, relating to eligibility for immigration benefits and the adjudicatory process.
Performs other related duties as assigned to support the mission and goals of USCIS and the Office of the Chief Counsel. Associate Counsel is supervised by the respective Field Division Chief and Deputy Chief.

Residency Requirement: There is a residency requirement for all applicants not currently employed by U.S. Citizenship and Immigration Services. This residency requirement states that candidates must have, for three of the last five years immediately prior to applying for this position; (1) resided in the United States; OR (2) worked for the United States Government as an employee overseas in a Federal or Military capacity, OR (3) been a dependent of a U.S. Federal or Military employee serving overseas. A two-year trial period is required for all appointees to a federal attorney position. Based on the documentation we have, you will be subject to this requirement.
